Testimony began Tuesday in the Jessica McCord manslaughter trial. McCord’s 11-month-old son drowned in the bathtub while bathing with his four-year-old brother. The prosecution has already announced one surprise witness, but say they’ve not yet decided if they’ll call the victim’s older brother as a witness. Eight men and five women jurors were chosen to hear the case.
McCord wasn’t home when her toddler son drowned in her bathtub in May of 2014. Her husband, John McCord, was left in charge. Prosecutors told jurors during opening statements that John McCord was mentally ill and that Jessica herself had committed him to a hospital for treatment shortly before the incident. Because of this, the prosecution says that Jessica knew the risk of leaving the boys with John and took it anyway.
