Capital murder trial of Foley man begins

Testimony began this afternoon in the capital murder trial of a Foley man charged in the shooting death of his ex-girlfriend in 2005.

Jeffrey Woodrow Kinsey, 28, shot Heather Nelson with a .22-caliber semiautomatic pistol Dec. 12, 2005, while she was in a vehicle with her 2-year-old son, according to testimony. The toddler was not injured, according to reports.

Defense attorney David Matheny said the shot was fired accidently during a struggle over the gun and Kinsey never intended to kill her. Kinsey called 911 and attempted CPR on Nelson, he said.
